Welcome to World Diapers. The World Diapers online store, available on this website, is operated by Rule's Scape Unip. Lda, with registered office at Rua do Passal 7, Neiva, 4935-537 Viana do Castelo, Portugal, tax number (NIF) 518815617 (VAT number PT518815617), email info@worlddiapers.com, phone 965677050. In these Terms, "we", "us", "our" and "World Diapers" refer to this company.
These Terms and Conditions (the "Terms") govern the use of this website and all purchases made through it. They apply together with our Privacy Policy, our Refund Policy and our Shipping Policy. Please read them carefully before placing an order. By completing a purchase, you confirm that you have read and accept these Terms.
These Terms are governed by Portuguese law and by European Union consumer protection law. Nothing in these Terms limits or excludes the rights you have as a consumer under the law.
SECTION 1: ACCESS AND ACCOUNT
To make purchases on this website you must be at least 18 years old or have the legal capacity to enter into contracts. When placing an order, you may be asked for certain information, such as your name, email address, billing and delivery address and payment details. You agree to provide true, current and complete information and to keep it up to date.
If you create an account, you are responsible for keeping your login details confidential and for all activity on your account. You may not transfer, assign or sell your account to anyone else.
SECTION 2: OUR PRODUCTS
We make every effort to present product features, sizes and weight ranges accurately. Images are for illustration only: colours may vary depending on your screen, and manufacturers may change packaging design without this affecting the product.
All products are subject to stock availability. We may limit quantities per order or per customer and discontinue products at any time, without affecting orders that have already been confirmed.
SECTION 3: ORDERS AND FORMATION OF THE CONTRACT
An order placed on the website is an offer to purchase. After you submit it, you will receive an email confirmation with a summary of your order. The contract is concluded upon that confirmation and is concluded in Portuguese (or in the language of the website used to place the order).
We may refuse or cancel an order if a product is out of stock, if there is an obvious error in the price or product description, or if there are reasonable grounds to suspect fraud. In such cases, we will inform you immediately and refund all amounts paid within 14 days at the latest.
Purchases are intended for personal or household use and not for resale.
SECTION 4: PRICES AND PAYMENT
All prices are shown in euros (€) and include VAT at the applicable legal rate. Shipping costs are not included in the product price and are clearly shown at checkout before you confirm your order. The applicable price is the one in force at the time of the order.
We may change prices, discounts and promotions at any time, but such changes do not affect orders already placed. Promotions may be subject to their own conditions, which are stated in the relevant communication.
The available payment methods are shown at checkout. Orders are only processed once payment has been confirmed. The invoice is issued using the details provided in the order.
SECTION 5: SHIPPING AND DELIVERY
Shipping is a flat rate per order:
- Portugal (mainland, Azores and Madeira): €4.80, with CTT.
- Spain: €4.80, with DPD.
- Rest of Europe: €9.90, with DPD.
Products in stock are dispatched within 24 hours (business days). In mainland Portugal, delivery is normally made within 48 hours of dispatch. Delivery times for the Azores and Madeira, Spain and other destinations are set out in our Shipping Policy. Delivery times are estimates; unless otherwise agreed, delivery is made within 30 days of the conclusion of the contract at the latest. If we cannot meet that deadline, you may terminate the contract in accordance with the law and we will refund all amounts paid.
The risk of loss of or damage to the products only passes to you when you, or a third party indicated by you other than the carrier, take physical possession of the products. For destinations outside the European Union, customs or import duties may be charged on arrival, and these are the customer's responsibility.
SECTION 6: RIGHT OF WITHDRAWAL
Under Portuguese Decree-Law No. 24/2014 of 14 February (which implements Directive 2011/83/EU), consumers have the right to withdraw from the contract within 14 days of the day on which they take physical possession of the products (or of the last product, for an order delivered in several shipments), without giving any reason.
To exercise this right, simply send us a clear statement by email to info@worlddiapers.com or by post to the address above; you may use the model form at the end of these Terms. You must return the products within 14 days of informing us of your decision. Practical return instructions are set out in our Refund Policy.
We will refund all payments received, including standard delivery costs, within 14 days at the latest of the day we are informed of your decision, using the same payment method used for the purchase. We may withhold the refund until we have received the products back or you have supplied proof of having sent them, whichever is earlier. You are only liable for any diminished value of the products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
For health protection and hygiene reasons, and in accordance with Article 17 of the same Decree-Law, the right of withdrawal does not apply to sealed products (such as packs of diapers, pull-up pants or wipes) that have been unsealed or opened after delivery.
In addition to this legal right, our Refund Policy offers a 30-day commercial return period, under the conditions set out there.
SECTION 7: LEGAL GUARANTEE
All products are covered by the legal guarantee of conformity under Portuguese Decree-Law No. 84/2021 of 18 October (which implements Directive (EU) 2019/771). We are liable for any lack of conformity that becomes apparent within 3 years of delivery. In the event of a lack of conformity, consumers are entitled to have the goods brought into conformity (repair or replacement), to a proportionate price reduction or to terminate the contract, in accordance with the law.
If you receive a damaged or defective product, or a product different from the one you ordered, please contact us at info@worlddiapers.com so we can resolve it as quickly as possible.
SECTION 8: GIFT CARDS
Gift cards are valid for 1 year from the date of purchase. The balance can be used in one or more purchases within that period. Each gift card has its own code; you can use several gift cards in the same purchase at checkout, but their balances are not combined into an account. Gift cards cannot be exchanged for cash, except where required by law. Keep your code safe: anyone who has it can use it.
SECTION 9: INTELLECTUAL PROPERTY
All content on this website, including text, images, logos, graphics, videos, design and software, is the property of Rule's Scape Unip. Lda or of third parties who have authorised its use, and is protected by Portuguese and European intellectual and industrial property law. The brands of the products we sell belong to their respective owners.
You may use the website for personal, non-commercial purposes only. You may not reproduce, distribute, modify or publish any content without our prior written permission.
SECTION 10: THIRD-PARTY TOOLS AND LINKS
The website may include tools provided by third parties (for example, payment methods or shipment tracking) and links to third-party websites. We do not control these services or websites and are not responsible for their content or practices. We recommend that you read their terms and policies before using them.
SECTION 11: RELATIONSHIP WITH SHOPIFY
This store is powered by Shopify. However, all purchases made in this store are contracted directly with Rule's Scape Unip. Lda. Shopify is not a party to the sales contract and is not responsible for any aspect of the sales made between you and us.
SECTION 12: PERSONAL DATA
Personal data collected through the website is processed in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy. As the store is hosted on Shopify, certain data may also be processed by Shopify, in accordance with the Shopify Privacy Policy.
SECTION 13: REVIEWS AND FEEDBACK
If you send us reviews, comments or suggestions, you allow us, free of charge and on a non-exclusive basis, to use and publish them on the website and in our communication channels. You agree not to post content that is false, unlawful, offensive or that infringes the rights of others. We may moderate or remove content that does not follow these rules.
SECTION 14: ERRORS AND OMISSIONS
Despite our care, the website may contain typographical errors or inaccuracies in descriptions, prices, promotions or availability. We reserve the right to correct them at any time. If an order already placed is affected by an obvious pricing error, we will contact you before dispatch so that you can confirm the order at the correct price or cancel it with a full refund.
SECTION 15: PROHIBITED USES
You may not use the website for unlawful purposes, transmit viruses or malicious code, collect other people's personal data, scrape content automatically, circumvent security measures, impersonate another person or do anything that harms the operation of the website, World Diapers or other users. We may suspend or close accounts if these Terms are breached.
SECTION 16: LIABILITY
We make every effort to keep the website available and secure, but we cannot guarantee that it will work without interruptions or errors. To the extent permitted by law, we are not liable for indirect damage resulting from the use of the website. This clause does not limit our liability for wilful misconduct or gross negligence, for death or personal injury, nor the consumer rights provided by law, in particular under Decree-Laws No. 24/2014 and No. 84/2021.
SECTION 17: COMPLAINTS BOOK
As required by Portuguese law, we have an electronic Complaints Book (Livro de Reclamações), available at www.livroreclamacoes.pt. You can also contact us directly at info@worlddiapers.com.
SECTION 18: ALTERNATIVE DISPUTE RESOLUTION
In the event of a consumer dispute, consumers may use an alternative consumer dispute resolution (ADR) entity, under Portuguese Law No. 144/2015 of 8 September, including:
- CNIACC, National Centre for Information and Arbitration of Consumer Disputes (www.cniacc.pt);
- CIAB, Consumer Information, Mediation and Arbitration Centre (Consumer Arbitration Court), competent for the Viana do Castelo region (www.ciab.pt).
The full list of ADR entities is available on the Portuguese Consumer Portal (www.consumidor.gov.pt). Consumers living in another European Union country can also get help from the European Consumer Centre in their country.
SECTION 19: GOVERNING LAW AND JURISDICTION
These Terms and the contracts concluded through the website are governed by Portuguese law, without prejudice to any more favourable mandatory provisions of the law of the consumer's country of habitual residence. The Portuguese courts have jurisdiction to settle disputes, without prejudice to the consumer's right to bring proceedings before the courts of their place of residence or to use an ADR entity, in accordance with the law.
SECTION 20: GENERAL PROVISIONS
If any provision of these Terms is found to be invalid, the remaining provisions will stay in force. Our failure to exercise a right under these Terms does not mean that we waive it. Section headings are for convenience only.
SECTION 21: CHANGES TO THESE TERMS
We may update these Terms at any time by publishing the new version on this page. Changes do not apply to orders placed before they are published: each order is governed by the Terms in force on the date it was placed.
